Terms of Service
The fine print. Written in plain English so you can actually read it before you sign. Last updated September 23, 2026.
These Terms of Service ("Terms") are a contract between you ("you", "Client") and Buzztower ("we", "us", "our"), based in Queen Creek, Arizona, USA. By engaging us for a project, starting a subscription, or using a website or product we build and host for you, you agree to these Terms. If you don't agree, don't use the service.
1. What we provide
Buzztower is a product studio. We design and build websites, web tools, and SaaS products, and for many clients we also host, maintain, and iterate on what we build under an ongoing subscription. The scope, deliverables, and pricing of your engagement are agreed with you directly, in the proposal, order details, or checkout you accept, before any work begins or any charge is made.
2. Term, minimum, and renewal
Ongoing subscriptions are billed at signup and on the same day each month thereafter. Some subscriptions include an initial minimum commitment; if yours does, it is stated in the order details you accept at signup. After any initial commitment, your subscription renews monthly on the same day until you cancel. Pricing in effect at signup applies to you; if we change pricing later, we'll give existing clients at least 30 days' notice by email before any increase applies to your subscription.
3. Payment
- Billing is handled by Stripe. You authorize us (through Stripe) to charge your card the agreed fee on a recurring monthly basis, starting at signup.
- Monthly charges are non-refundable except where required by law or where we've made a clear mistake (e.g. duplicate charge).
- If a payment fails, we'll email you and retry. If a payment is more than 14 days overdue we may pause or take down your site or product until the balance is paid.
- You're responsible for keeping a valid payment method on file through the Stripe customer portal in your client account.
4. Cancellation
- You can cancel any time from your client account ("Manage billing" opens the Stripe customer portal) or by contacting us through our contact form. If you can't get into your account, ask through the contact form and we'll sort out access.
- If your subscription includes an initial minimum commitment, cancellations requested during that period take effect at the end of it; charges already billed are not refunded on cancellation.
- Cancellations after any minimum take effect at the end of the current billing month. You keep access until then.
- When your subscription ends, we will take your hosted site or product offline. You can request an export of your content and copy within 30 days of cancellation.
- Domain names you own stay yours. If we registered the domain on your behalf, we'll transfer it to a registrar account of your choice on request.
5. Your responsibilities
- Give us accurate information and content (business details, photos, copy, requirements).
- Respond to our content and feedback requests reasonably promptly so we can build and launch on schedule.
- Make sure you have the right to use any content (photos, logos, copy, customer reviews) you send us.
- Comply with all laws that apply to your business, including licensing, advertising, and consumer-protection rules.
- Don't use the service to publish content that is illegal, infringes someone else's rights, harasses people, or contains malware.
6. Content ownership and license
You own your content. Any text, photos, logos, and other materials you send us remain yours. You grant us a worldwide, non-exclusive license to host, display, copy, modify, and distribute that content for the purpose of operating your project and providing the service. This license ends when your engagement ends.
We own the platform. The Buzztower codebase, design system, templates, internal tools, and the underlying frameworks remain our property. We grant you a license to use the live site or product we build for you for as long as your subscription is active, unless your proposal says otherwise. We may reuse generic layout patterns, component code, and styling techniques on other clients' projects.
We may display a small "Built by Buzztower" credit in the footer of your site. You can ask us to remove it at any time.
7. Service level & availability
We aim for high uptime but don't promise an SLA-backed guarantee. We rely on third-party hosting and DNS providers, and outages can occasionally happen. If your site or product is down because of something we can fix, reach out through our contact form and mention it's urgent, and we will jump on it the same day.
8. Support and edits
Support requests start with our contact form; we respond by email. Reasonable edits to your existing content (copy tweaks, new photos, updating details) are included in ongoing subscriptions. New pages, brand-new design builds, custom integrations, or major rework that falls outside the agreed scope may require a quote and a separate project fee.
9. Third-party services
Your project and account may rely on third-party services (Stripe for payments, Clerk for sign-in, Google for fonts and Maps, your CRM, etc.). Those services have their own terms and privacy policies, and we are not responsible for outages, bugs, or policy changes on their side.
10. Disclaimers
We will work hard to build you a great site or product, but we don't guarantee specific search rankings, traffic numbers, or revenue outcomes. Those depend on factors we don't fully control (your market, your competitors, search and platform algorithms).
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR LOST LEADS), EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
12. Indemnification
You agree to defend and indemnify us against any third-party claim arising from (a) content you give us to publish, (b) your violation of these Terms, or (c) your violation of any law in operating your business.
13. Termination by us
We may suspend or terminate the service if you materially breach these Terms (for example, non-payment beyond 14 days, illegal content, or abusive behavior toward our team). We will give you reasonable notice when we can.
14. Governing law & disputes
These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona, and both parties consent to that jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date and email active clients at least 30 days before the change takes effect. Continued use of the service after that means you accept the updated Terms.
16. Entire agreement
These Terms, together with our Privacy Policy and the proposal or order details you agreed to, are the entire agreement between you and Buzztower regarding the service.
